Detention Review

Canada has a detention review system that is not as strict as in the United States. Canada’s system is more lenient, and they have a higher rate of granting release.

Detention review in Canada is a process where the court reviews the case of an individual who has been detained by immigration authorities to determine whether or not they should be released.

In order for an individual to be eligible for detention review, they must be detained under one of Canada’s immigration laws, which include:

-The Immigration and Refugee Protection Act (IRPA),

-The Passport Order

-The Citizenship Act

-The Immigration and Refugee Protection Regulations (IRPR)

-A warrant issued under IRPA or IRPR

The Canadian Government is currently reviewing its immigration detention policy, with a focus on the use of detention as a last resort, and on minimizing the length of detention.

The government has appointed former Supreme Court Justice Thomas Cromwell to lead this review. His first report will be released in December 2017.

Canada’s immigration detention system is not as extensive as that of some other countries, but it does detain about 4500 people per year for administrative purposes.
