Inadmissibility Medical/Criminal

Medical inadmissibility is a term used to describe the inability of a person to immigrate to Canada because they have a communicable disease.

Criminal inadmissibility is the inabilities of an individual to enter Canada if they have been convicted of a crime, sentenced to more than six months imprisonment, or are currently incarcerated.

Medical inadmissibility is determined by Citizenship and Immigration Canada (CIC) on a case-by-case basis. It is not automatically granted unless the person has been deemed admissible by CIC. The individual must provide medical documentation proving that he/she does not pose any risk to Canadians’ health and safety.

Criminal inadmissibility is determined by CIC on the basis of an individual’s criminal record and their current situation (i.e., whether they are incarcerated). If an individual has served six months or more in prison for one crime, then he/she will be considered criminally inadmissible.

There are three ways that a person can be found inadmissible in Canada. They are: 1) the person has committed a serious crime outside Canada, 2) the person has been convicted of a crime in Canada, or 3) the person has a physical or mental disorder and poses an unacceptable risk to Canadian society.

The first way is relatively straightforward. If you have committed a serious crime outside of Canada, then you will not be allowed into the country unless you apply for and receive an exemption from Citizenship and Immigration Canada (CIC).

It is more difficult to determine when someone has been convicted of a crime in Canada because there are different types of criminal records. A summary conviction can result from anything from shoplifting to assault, while an indictable offense is usually more serious, such as murder. The difference between summary and indictable offenses can make it hard for CIC officers to determine whether or not someone should be.

The inadmissibility medical examination is a medical screening that is required for individuals who are applying to enter Canada.

Individuals with certain medical conditions or diseases may be found medically inadmissible to Canada. The list of conditions and diseases that can make an individual medically inadmissible is called the Medical Surveillance List (MSL).

A criminal record may make an individual ineligible to enter Canada. An applicant with a criminal record may be found criminally inadmissible to Canada.
